Kyle Odom Will Not Face Attempted Murder Charges

Kyle Odom is accused of shooting a northern Idaho Pastor 6 times with a .45 handgun in March, but he will no longer face charges of attempted murder.

According to the Spokesman-Review, prosecutors changed the attempted murder charge Wednesday to aggravated battery.

The change could actually help the prosecution, according to the report, because both crimes carry the same maximum sentence of 15 years in prison, but battery can be easier to prove. Odom is also charged with using a deadly weapon in committing the felony – a potential sentence enhancement that could give him another 15 years behind bars if convicted.

A preliminary hearing for Odom, set for June 3rd.
