Prosecutors will seek the death penalty against Timmy Kinner

Ada County Prosecutors will seek the death penalty against Timmy Kinner, the man suspected of killing a 3-year-old girl at her birthday party over the summer.

Kinner is charged with the first-degree murder of 3-year-old Ruya Kadir who police say was fatally attacked at her birthday party.

Police say he was staying at the Wylie Street Station apartments when he was asked to leave after residents became concerned with his behavior, which he did peacefully.

However, police say he returned with a knife and started attacking people. He’s also facing eight counts of aggravated battery, one count of burglary as well as two counts of aggravated assault and weapon enhancement.

CBS 2 News reports, if Kinner is convicted and sentenced to death, he would join the eight men and one woman currently on Idaho’s Death Row.
