A man who was driving with a blood alcohol content level nearly four times the legal limit when he seriously injured two Middleton teenagers in a head-on crash was sentenced Monday to 13 years in prison.
Jose Diaz Jr. was driving on a suspended license and without insurance, when he blew a stop sign at the intersection of River Road and State Highway 44 around midnight on March 10th.
The Idaho Press reports, his choice to drive on a suspended licence, without insurance and while under the influence with a blood alcohol level of 0.30 were three reasons the prosecution pushed for a 15-year prison sentence with seven years fixed.
Diaz was initially charged with two counts of felony aggravated DUI and misdemeanor driving without privileges. He pleaded guilty to one aggravated DUI charge in June as part of a plea deal.
Third District Court Judge Thomas Whitney ultimately gave Diaz a 13-year sentence, with four years fixed, due to Diaz being a danger to society.
